Generative AI in Corporate Insolvency
AkinBC, supported by the UK Government’s Insolvency Service, is leading global research into the use of Generative AI in corporate insolvency, exploring how AI could improve efficiency and effectiveness while reflecting strong practitioner appetite for innovation.
Akin Business Constructs, with the support of the UK Government’s Insolvency Service, is completing a multi‑stakeholder research project to examine whether Generative Artificial Intelligence (AI) can support the delivery of key tasks in corporate insolvency proceedings, with improved outcomes in efficiency and effectiveness.
The research adopts a mixed‑methods approach, combining qualitative insights with quantitative analysis, and has engaged insolvency practitioners, academics, policymakers, and other subject‑matter experts from over 20 jurisdictions worldwide. This global perspective reflects the increasingly cross‑border nature of insolvency work and the shared operational challenges faced by practitioners across different legal systems.
Findings from the qualitative phase reveal significant appetite for innovation in the sector. While 44% of insolvency experts surveyed consider current corporate insolvency proceedings to be inefficient, an overwhelming 89% indicated they would be willing to use AI as part of their work, provided it demonstrably improves efficiency. Despite this openness, only 36% of respondents have used AI tools to date, primarily relying on non‑specialised platforms such as ChatGPT and Copilot rather than tools designed specifically for insolvency processes.
Building on these findings, the quantitative design experiment phase will involve close collaboration with machine learning and deep learning experts. This phase aims to better understand the technological requirements, limitations, and implications of deploying AI solutions within corporate insolvency proceedings, including how such tools might be designed responsibly and effectively for professional use.
