This privacy policy aims to give you information on how Akin Business Constructs collects and processes personal data through the use of this website and any data you may provide when you use our services.
It is important that you read this privacy policy together with any other privacy-related notice(s) we may provide on specific occasions (such as due diligence checks) so that you are fully aware of how and why we are using your personal data.

THE TYPE OF PERSONAL INFORMATION WE COLLECT

Personal data, or personal information, means any information about an individual from which that person can be identified. This includes visual, voice and biometric data. At ABC, we always treat your personal information in a safe and secure manner and always for the reason for which it was obtained.

 

Most of the personal information we process is provided to us directly by you. We receive personal data via the following methods:

  • You wish to make contact with us about our services – when you complete the contact form on our website, we record the following personal information in order to help us to understand and respond to your query:

    • Name

    • Email address

    • Which industry you work in

  • You wish to start a formal engagement with us – when we agree to work with our clients, we ask them to complete an onboarding form that enables us to fulfil our contractual and regulatory obligations such as:

    • Name

    • Address

    • Email address

    • Telephone number

    • Date of Birth

    • Company information

  • You have instructed us to carry out specific services that require further vetting – certain business transactions may be subject to anti-money laundering diligence checks in accordance to UK regulation. In these circumstances, we may request further company information.

  • We have been instructed by our client to carry out services with you on their behalf that require some vetting – where ABC is instructed by a client to undertake some vetting on their behalf, ABC will ask the third party to complete a due diligence form that enables us to perform Know Your Business (KYB) checks in line with UK anti-money laundering regulation. In these circumstances, we may request the third party’s company information including personal details about the company’s representative.

 

We also obtain personal information indirectly, from publicly available data sources such as Companies House during the course of a formal engagement. We use this information to verify the information that you or an involved third party provide to us or inform the services that we are providing to you in the course of a formal engagement.

WHY DO WE COLLECT IT

Under the General Data Protection Regulation (GDPR), the lawful basis for processing this information is we have a contractual obligation. This means that we will only process your data:

  • To comply with our obligations under the contract, or to process payment details.

  • If we haven’t yet got a contract with you, but you have asked us to do something as a first step (e.g. provide a quote) and we need to process your personal data to do what you ask.


In this context, a contract does not have to be a formal signed document; as long as terms have been offered and accepted, both parties intend them to be legally binding, and there is an element of exchange (usually an exchange of services for money).

HOW WE STORE YOUR PERSONAL INFORMATION

Your information is securely stored on the organisation’s cloud storage devices. We keep personal details, contact information and company information for five years. We will then dispose of your information by erasing it from the cloud storage.

Data is stored for five years for the following reasons:

  • To comply with legal or regulatory requirements. For example, income tax and audit purposes.

  • To defend possible future legal claims.

Under data protection law, as a data subject you have rights to control how and when your data is used. These are:

  • Your right of access - You have the right to ask us for copies of your personal information (commonly known as a “data subject access request”).

  • Your right to rectification - You have the right to ask us to correct any personal information that we hold about you that is inaccurate or incomplete.

  • Your right to erasure - You have the right to ask us to delete or remove your personal information where there is no good reason for us continuing to process it.

  • Your right to restriction of processing - You have the right to ask us to suspend the processing of your personal information in certain circumstances: (a) if you want us to establish the data’s accuracy; (b) where our use of the data is unlawful but you do not want us to erase it; or (c) where you need us to hold the data even if we no longer require it as you need it to establish, exercise or defend legal claims;

  • Your right to data portability - You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.

EXERCISING YOUR DATA PROTECTION RIGHTS

You can ask us to action these rights at any time and we have 1 month to comply with the request. In order to do so, please contact us at consult@akinbc.com with details of the request. We will then verify your identity and action it.

You are not required to pay any charge for exercising your rights.

We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website.
